Your Rights

The laws protecting your rights within the European Union are outlined in the European Parliament and Council’s Regulation EC 261/2004, also known as EU261. Fret not, the regulation was adopted by the British government pre-Brexit in 2019 and IF your flight was operated by a European airline, OR, by a non-European airline BUT you departed from the UK or an EU country, your right to claim compensation from airlines in the event of a flight delay, cancellation, or overbooking is still protected.

When your flight is delayed, your passenger rights allow you to claim delayed flight compensation for flights arriving at least 3 hours later than originally scheduled.

When your flight is cancelled, there are more factors to consider. In general, if your flight was cancelled less than 14 days prior to the planned departure, you could be eligible for compensation. However, did the airline offer you an alternative flight? Did you accept it? If you answered NO to any of these two questions, you may also be entitled to a full ticket refund on top of compensation.

So, how much damage can you do? The amount you can claim from airlines depends on the distance of the flight. The distances and according compensation amounts are as follows:

  • You are entitled to up to £220 for flights shorter than 1,500km;
  • up to £320 for flights between 1,501km and 3,500km, and;
  • up to £520 for flights longer than 3,500km.

Say you took a flight from London Gatwick to Barcelona and Ryanair delays your flight by a minimum of three hours – you can claim up to £220 in Ryanair flight delay compensation! Now imagine the flight you took was from London to New York instead – you are entitled to claim up to £520.
